COMMENTS:  The Control Of Smoking Products For Public Health Act 2024 is the primary piece of tobacco control legislation regulating, among other things, smoke free environments; tobacco advertising, promotion and sponsorship; tobacco packaging and labeling; sales restrictions, content and emissions regulation and disclosure. The Act regulates all smoking products, including tobacco products, smoking substances, and substitute tobacco products, and therefore, it regulates e-cigarettes and heated tobacco products as well as traditional tobacco products.   

COMMENTS: The Appointment of Date of Coming into Operation provides that the Control of Smoking Products for Public Health Act 2024 comes into operation on October 1, 2024.

COMMENTS: The Control of Smoking Products for Public Health (Declaration of Non-Smoking Area or Place) Order 2024 regulates smoke-free environments, including indoor public places, workplaces, and public transport, and outdoor places.

COMMENTS: The Control of Smoking Products for Public Health (Warning Sign of Prohibition of Smoking) Regulations 2024 regulates the display of no-smoking signs in smoke free environments.

COMMENTS: The Control of Smoking Products for Public Health (Compounding of Offenses) Regulations 2024 addresses procedures for compoundable offenses. COMMENTS: The Control of Smoking Products for Public Health (Control of Sale) Regulations 2024 place restrictions on sales, including by vending machine and internet, as well as location-based restrictions. The regulations also regulate product display at point of sale and retail price.

COMMENTS: The Control of Smoking Products for Public Health (Registration of Tobacco Product, Smoking Substance and Substitute Tobacco Product) Regulations 2024 governs the registration application and process for tobacco products (including smoked, smokeless, and heated products), smoking substances, and substitute tobacco products.
