Sale of e-cigarettes
The law prohibits the trade, sale, distribution, importation and exportation of any object that resembles tobacco but is not tobacco. The retail sale of e-cigarettes is prohibited under this law. In addition to the prohibition contained in the General Law on Tobacco Control, importation and exportation of e-cigarettes are prohibited under the Law of General Taxes of Imports and Exports, and circulation and commercialization are prohibited by presidential decree.
However, numerous court decisions permitted certain retailers to sell e-cigarettes. Aside from these retailers, the ban is still in effect.
Use in indoor public places, workplaces, and public transport
The law prohibits smoking, consuming, or having any nicotine or tobacco product in all indoor public places, workplaces, and on public transport. This is interpreted as including e-cigarettes. Designated smoking areas, where permitted, must be located in open air spaces.
Advertising and promotion (excluding point of sale product display)
The law prohibits the display and promotion of any object that resembles tobacco but is not tobacco. The advertisement of e-cigarettes is not permitted under this law.
