COMMENTS: Law No. 2014-14 Concerning the Manufacture, Packaging, Labeling, Sale and Use of Tobacco regulates, among other things, restrictions on public smoking; tobacco advertising, promotion and sponsorship; and tobacco packaging and labeling. The law also prohibits any interference by the tobacco industry in national health policy.

Decree No. 2016-1008 concerning the implementation of Law No. 2014-14 of March 28, 2014 concerning the manufacture, packaging, labeling, sale and use of tobacco
COMMENTS: Decree No. 2016-1008 elaborates upon the regulations in Law No. 2014-14 and sets forth grounds for subsequent subsidiary legislation regarding packaging and labeling requirements. The provisions banning flavored tobacco products entered into force on May 17, 2017.

Administrative Order No. 18416 concerning signs prohibiting smoking in public places or places open to the public or to common use, work places and public transportation vehicles
COMMENTS: Administrative Order No. 18416 specifies the details of the signage required to be posted to indicate smoke free areas. The order includes as an annex a "graphic chart" which sets out the specifications of the required signs.
Administrative Order No. 18415 determining the list of health warnings, procedures for their placement and renewal on packages of tobacco and tobacco products
COMMENTS: Administrative Order No. 18415 establishes the specific contents and rotation schedule of the health warnings required to appear on tobacco product packaging. The order includes an annex that provides the health warning images and messages as well as guidance related to their placement on packaging. Pursuant to a subsequent circular issued by the Minister of Health and Social Affairs, the implementation date for health warnings is August 26, 2017.
Circular No. 02988 to Manufacturers, Producers and Importers of Tobacco and Tobacco Products on Implementation of Health Warnings
COMMENTS: Circular No. 02988 was issued by the Minister of Health and Social Affairs to notify manufacturers, producers, and importers of tobacco products that they will be granted an additional six months to comply with the health warning requirements contained in Decree No. 2016-1008 and Administrative Order No. 18415. As a result, the new implementation date for health warnings is August 26, 2017.

Letter from the Ministry of Health and Social Affairs to Director General of MTOA (Imperial Tobacco) Transmitting the Health Warnings for the Next Twenty-Four (24) Months
COMMENTS: In this letter, the Ministry of Health and Social Affairs is informing the Director General of MTOA (Imperial Tobacco) of the health warnings for the next 24 months. With the letter, the Ministry sent two health warning images. Image 3 is to be used for the 12 months beginning August 26, 2019. Image 4 is to be used for the 12 months beginning August 26, 2020. Similar letters were sent to other manufacturers.
