Guinea became a Party to the WHO Framework Convention on Tobacco Control on February 5, 2008.

Smoke Free Places

The law prohibits smoking in certain enumerated public places, including government offices, healthcare facilities, educational facilities, sports facilities and stadiums. However, other types of public places - including restaurants, bars, hotels, bus and train stations, and airports - are required to have designated smoking areas. Public transportation is smoke free.

Tobacco Advertising, Promotion and Sponsorship

All forms of tobacco sponsorship are prohibited. The law appears to ban all forms of tobacco advertising and promotion as well. However, due to the lack of definitions for key terms in the law, the exact scope of the ban is uncertain.

Tobacco Packaging and Labeling

The law authorizes one text-only health warning, which must occupy 30 percent of the front and back of the package. Misleading packaging and labeling, which could include terms such as “light” and “low tar” and other signs, is prohibited.

Cigarette Contents and Disclosures

The law does not grant the authority to regulate the contents of cigarettes. The law requires that manufacturers and importers disclose to government authorities information on the contents of their products, but does not require disclosure of information on emissions.

Sales Restrictions

The law does not restrict the sale of tobacco products via vending machines or the internet, nor are there restrictions on the sale of single cigarettes or small packets of cigarettes. The law does not specify a minimum age for the purchase of tobacco products.

Roadmap to Tobacco Control Legislation

Law No. L/2012/039/CNT Concerning the Commercialization, Consumption, Advertising and Sponsorship of Tobacco and its Derivative Products is the primary law on tobacco control and governs smoking in public places; tobacco advertising, promotion and sponsorship; and tobacco packaging and labeling. The law replaces previous Ministry of Public Health orders, including Order No. A/2003/0442, Order No. 2003/0442, Order No. 2004/972, and portions of Order No. 94/5099. Ministry of Economy and Finance Order No. 473-40 on Customs sets the import tax on cigarettes.
