Non-Smokers' Rights Association v. Taieb

Non-Smokers' Rights Association (DNF) brought suit against "Club Cigare" magazine, its publishing company and editor for promoting cigars, particularly through the use of a famous actor's image and quotes. The court held that the magazine was not liable as it was a trade magazine and was registered and authorized to publish tobacco ads. Moreover, the magazine had received no notice of a potential tobacco control law violation despite having been reviewed by a commission several years prior to the suit.
