Echo Communication, a newspaper publisher, printed three photos of race car drivers with tobacco branding on their uniforms competing in the Paris-Dakar race. The lower court found no tobacco advertising violation and ordered the Tobacco Victims Assistance Association to pay partial legal costs. The association appealed, and the appeals court affirmed the lower court decision finding no advertising violation. The court observed that the uniforms' branding was not advertising but simply a part of the news article.
