Analysis

Any person who violates provisions on tobacco advertising under Law No. 457 of 2004, Art. 3(1), is subject to a fine from 10,000 lei to 50,000 lei. Legal entities that violate provisions on brand stretching under Law No. 349 of 2002 are subject to a fine of 5,000 lei for a first violation; a fine of 10,000 lei and the suspension of operations until the situation is remedied for a second violation. Subsequent violations are subject to a fine of 15,000 lei and the shutting down of the facility.

The law aligns with FCTC Art. 13 and the FCTC Art. 13 Guidelines in that it imposes fines on any person that violates provisions on tobacco advertising.

Analysis

Any person that violates provisions on tobacco sponsorship under Law No. 457 of 2004, Art. 4(1) (prohibiting sponsorship of cross-border events/activities), Art. 4(4) (prohibiting sponsorship of events/activities intended for youth under 18), and Art. 4(5) (prohibiting sponsorship of events/activities at medical and medico-pharmaceutical educational facilities) is subject to a fine from 10,000 lei to 50,000 lei. A repeat violation of Art. 4(1) is subject to the same fine and suspension of activities.

The law aligns with FCTC Art. 13 and the FCTC Art. 13 Guidelines in that it imposes a range of penalties and increased penalties for repeat violations.
