Sale of e-cigarettes
The law bans the supply of e-cigarettes except by prescription-only for smoking cessation. Note, however, that although e-cigarettes may be prescribed for smoking cessation, they have not been approved by the Therapeutic Goods Administration for this or any other purpose. Therefore, they can be prescribed as “unapproved” products.
Use in indoor public places, workplaces, and public transport
There is no national law addressing the use of e-cigarettes in indoor public places, workplaces, and public transport. In Australia, restrictions and prohibitions on smoking and e-cigarette use generally fall within the jurisdiction of the States and Territories. Many States and Territories have introduced legislation to include the use of e-cigarettes in smoke-free legislation. Therefore, the regulatory status code "Some Restrictions" is given.
Advertising and promotion (excluding point of sale product display)
As a Schedule 4 (poison) product, the law bans the advertising of e-cigarettes except in genuine professional or trade journals or other publications intended for circulation only within the medical, nursing, or pharmaceutical professions or the wholesale drug industry. Because advertising is only permitted in trade publications, the regulatory status code “Banned” is given.
Point of sale product display

For e-cigarettes available by prescription, the product packaging must be child-resistant and include the following warning statements:
(a) “KEEP OUT OF REACH OF CHILDREN”; and
(b) “Avoid contact with eyes”; and
(c) “Avoid contact with skin”.
All ingredients and flavors must be listed along with the concentration of nicotine. This information must be on or attached to the container or the primary pack; or supplied with the container or the primary pack of a nicotine vaping product.
All information must be:
(a) in English;
(b) legible;
(c) visible and not obscured; and
(d) durable.
Maximum nicotine concentration

For e-cigarettes available by prescription, the maximum content of nicotine in e-liquid must not exceed 100 mg/g.
