Analysis

Article 12.25(1) of the Code of Administrative Offenses imposes penalties for repeat violations (two or more in one year) of requirements on conformity assessment and standardization of tobacco products. Penalties include a fine on individual entrepreneurs in an amount ranging from 10 to 20 base units, and a fine on legal entities ranging from 80 to 100 base units with or without confiscation of the subject of the administrative offense.

The law aligns with FCTC Art. 9 and the FCTC Arts. 9 & 10 Partial Guidelines in that it imposes sanctions for content regulation violations.

Article 12.25(2) of the Code of Administrative Offenses imposes penalties for the sale of tobacco products without the necessary documents and/or labels required by law and/or the EEC Technical Regulations. Penalties include a fine on individual entrepreneurs in an amount ranging from 10 to 20 base units, and a fine on legal entities ranging from 30 to 50 base units with confiscation of the subject of the administrative offense.

The law aligns with FCTC Art. 10 and the FCTC Arts. 9 & 10 Partial Guidelines in that the law imposes sanctions for disclosure violations.
