COMMENTS: The provisions of Law No. 2006-12 were replaced by Law No. 2017-27 to the extent that they are contrary to the requirements contained in Law No. 2017-27.
Decree No. 2009-702 Concerning Organization of Control of the Production, Importation, Commercialization and Consumption of Cigarettes and Other Tobacco Products
COMMENTS: Decree No. 2009-702 was issued under Law No. 2006-12 and regulated tobacco product packaging and labeling and identifies several agencies responsible for enforcement. The requirements were superseded by those contained in Law No. 2017-27.

Interministerial Order No. 020 Setting the Terms for the Use of Cigarettes and Other Tobacco Products by Smokers in Places for Shared Use
COMMENTS: Interministerial Administrative Order No. 20, dated May 24, 2011, was issued under Law No. 2006-12 and regulated restrictions on smoking in public places and establishes associated duties. The requirements were superseded by those contained in Law No. 2017-27.
Law No. 2017-27 Concerning the Production, Packaging, Labeling, Sale and Use of Tobacco, its Derivatives and Similar Items in the Republic of Benin
COMMENTS: Law No. 2017-27 is the primary law regulating restrictions on smoking in public places; tobacco advertising, promotion, sponsoring; packaging and labeling of tobacco products; cigarette contents and disclosure; and sales restrictions on tobacco products. This law supersedes any conflicting provisions in prior laws, particularly Law No. 2006-12 and its implementing regulations.
Decree No. 2021-0065 on Visual and Written Health Warnings to Be Printed on Cigarette Packages and Other Tobacco Products
COMMENTS: Decree No. 2021-0065 requires pictorial health warnings to cover 90% of the front and back of tobacco product packaging. The decree includes four warnings to appear on packaging for a period of two years. Manufacturers and importers were given nine months after the date of signature to comply with the provisions - March 11, 2022.
Decree No. 2022-073 Setting the Conditions and Procedures for Issuing Approvals for the Manufacture and Importation of Tobacco, Its Derivatives and Similar Products in the Republic of Benin
COMMENTS: Decree No. 2022-073 establishes the conditions and procedures for the approval of the manufacture and import of tobacco and similar products, including e-cigarettes, into Benin. Among its provisions, it bans the sale of tobacco products and e-cigarettes via the internet, by vending machine, and any other virtual means. The decree was subsequently amended by Decree No. 2023-536.
