Tobacco Product
“Tobacco product” means a product composed in whole or in part from the leaf of the tobacco plant as raw material which is manufactured for human consumption.
The law’s definition of “tobacco product” aligns with the definition of “tobacco product” in the FCTC Art. 1(f).
Any product entirely or partly made of the leaf tobacco as a raw material which is manufactured to be used for smoking, sucking, chewing, or snuffing. (FCTC Art. 1(f))
Outside Packaging and Labeling
“Package” means any covering, wrapper, box, container, carton or other enclosure that contains a tobacco product and includes a box, carton, cylinder, packet, pouch or tin.
The law’s definition of "package" does not clearly state that it applies to all packaging and labeling used in retail sale, including unit packaging and surrounding outer packaging, although this is likely the intent given that the definitions includes the word “carton.” To align with FCTC Art. 11 and the FCTC Art. 11 Guidelines, the law should clearly state that "package" includes all packaging and labeling used in the retail sale of a tobacco product.
