COMMENTS: The Tobacco Control Act of Bhutan 2010 is the primary piece of tobacco control legislation. The law establishes smoke free places; prohibits the cultivation, manufacture, sale, and distribution of tobacco products; and restricts the import of tobacco products for personal consumption only. Among other things, the law also regulates tobacco advertising, promotion and sponsorship.

The law has been amended several times, most recently in 2021. A consolidated version incorporating these amendments is uploaded here, and an updated legislative analysis is forthcoming.

COMMENTS: The Tobacco Control Rules and Regulations 2011 were replaced by the Tobacco Control Rules and Regulations 2013. The 2011 rules are provided here for information purposes only.

COMMENTS: Public Notification No. 7345 clarifies certain provisions of the Tobacco Control Act of Bhutan 2010 related to the ban on smoking in public places and the duties placed on persons in charge of the premises.

COMMENTS: The Tobacco Control (Amendment) Act 2012 was repealed by the Tobacco Control (Amendment) Act 2014.

It had amended several provisions of the Tobacco Control Act of Bhutan 2010 to clarify offenses, penalties, and enforcement authorities. The amendments also adjusted the maximum permissible quantities of tobacco products for import for personal consumption.

COMMENTS: The Tobacco Control Rules and Regulations 2013 were issued under the Tobacco Control Act of Bhutan 2010 and govern smoke free places; importation and duties; and duties and powers of enforcement authorities.

COMMENTS: The Tobacco Control (Amendment) Act 2014 amends the Tobacco Control Act 2010 and repeals the Tobacco Control (Amendment) Act 2012. A consolidated version of the Act incorporating these and other amendments is provided above.

COMMENTS: Public Notification No. 095 notifies the public about the 2021 amendments to the Tobacco Control Act of Bhutan 2010.
