Advertising and promotion (excluding point of sale product display)
The law defines “tobacco products” as “all types of products made of tobacco leaf, strands of tobacco or any substance of tobacco produced by tobacco industrialists or by any other means to be used for direct smoking or other forms including sucking, chewing, dipping or snuffing.” Because the definition includes “substance of tobacco products by tobacco industrialist,” and products used for “smoking” and “sucking,” HTPs fall within the definition of “tobacco products.” Emissions from HTPs are tobacco smoke. Further, HTP emissions are inhaled by users and drawn from the product through the process of sucking. Therefore, existing tobacco advertising and promotion restrictions are interpreted to apply to tobacco inserts. The law prohibits most forms of tobacco advertising and promotion.
Circular No. 001/21 banning the sale of HTPs does not specifically address the advertising and promotion for devices and the tobacco control law does not define “tobacco advertising and promotion.” Although devices directly and indirectly promote the use of tobacco products, which includes tobacco inserts, it is uncertain how regulators are interpreting advertising and promotion restrictions for devices. Therefore, the regulatory status code “Uncertain” is given.
Sponsorship

The Law on Tobacco Control prohibits some forms of sponsorship; specifically, sponsorship of concerts, sports events, or other public events, and only where tobacco products or brand names are shown. In other words, if the tobacco products or names are not shown, financial support is permissible for these types of events, and financial support is permissible for all other types of events, activities, and individuals. In addition, the Sub-Decree on Advertising specifically allows sponsorship of humanitarian activities or corporate social responsibility programs if tobacco advertising is not shown.
At least one ministry, the Ministry of Education, Youth, and Sport, has issued a circular instructing all ministerial and educational facilities not to partner with or accept any sponsorship by the tobacco industry, including charitable endeavors.
