Sales Restrictions
Decree No. 2018-218 implements the ban on tobacco advertising and promotion contained in Art. 8 of Law No. 12-2012. Therefore, a violation of the ban on vending machine or internet sales (contained in Decree No. 2018-218) is subject to the same penalty as tobacco advertising and promotion violations, which is a fine of ranging from 4,000,000 to 10,000,000 CFA francs.
Location-based Sales Restrictions
Violations of the ban on sales in educational facilities are subject to a fine ranging from 200,000 to 1,500,000 CFA francs. Fines for repeat offenses range from 1,500,000 to 3,000,000 CFA francs.
Decree No. 2018-218 implements the ban on tobacco advertising and promotion contained in Art. 8 of Law No. 12-2012. Therefore, a violation of other location-based sales restrictions (sales outside of a “point of sale”) (contained in Decree No. 2018-218) is subject to the same penalty as tobacco advertising and promotion violations, which is a fine ranging from 4,000,000 to 10,000,000 CFA francs.
Minimum Retail Package Size
The law does not regulate the minimum size of tobacco product packages; therefore, there are no associated penalties.
Minimum Legal Sales Age
Violations of the ban on sales to persons below the age of 18 are punishable by a fine ranging from 200,000 to 1,500,000 CFA francs. Fines for repeat offenses range from 1,500,000 to 3,000,000 CFA francs.
