Enforcement Authorities
Ministry of Health
Under the Law, the Ministry of Health is the primary enforcement authority. According to the Regulations, the Ministry has the duty to conduct inspections of smoke free places.
Municipalities
The Law gives enforcement authority to the municipalities, and the Regulations specify that municipalities are mandated to “collaborate in the enforcement of provisions contained in Chapter II” (smoke free provisions).
Ministry of Labor and Social Security
The Law gives enforcement authority to the Ministry of Labor and Social Security. The Regulations specify that “the Labor Inspectors of the Ministry of Labor and Social Security, shall have collaborating or auxiliary officials to assist them.” The Regulations also specify that the “Council of Occupational Health shall collaborate in the prevention of consumption of tobacco products and derivatives.”
Ministry of Public Safety
The Law states that: “the Ministry of Public Safety shall collaborate with the authorities indicated . . . in the oversight, enforcement and execution of this law and its regulation.” The Regulations further state that “[t]he Ministry of Public Safety, through the General Bureau of the Constabulary, shall draw up the protocol of operational action that ensures its cooperation in the control, verification and execution of the Law and its regulation.”
