(e.g., seizure of the product, publication of the violation/violator)
Anyone who contravenes the provisions concerning health warnings or packaging and labeling of tobacco products is subject to imprisonment of six months to two years, a fine of 5,000,000 to 50,000,000 francs CFA, or both. In addition, a legal entity that violates these provisions may be dissolved, closed for a period of six months to one year, and/or have property used in the commission of the infraction confiscated.
The law aligns with FCTC Art. 11 and the FCTC Art. 11 Guidelines with respect to imposing a range of penalties. However, the law should clearly state which government entity is responsible for enforcing packaging and labeling requirements.
