Penalties for the violation of any provisions of the law include warnings, a reprimand, confiscation and/or destruction of the offending product and monetary fines. Penalties for repeat offenses are doubled.
The law aligns with FCTC Art. 11 and the FCTC Art. 11 Guidelines in that it imposes a range of penalties and increased fines for repeat offenses. The law could be strengthened by designating a government body responsible for enforcement and by specifying that manufacturers, importers, wholesalers, and retailers bear legal responsibility for compliance.
