Rural municipality and city governments (for retail trade)
Manufacturers that violate packaging and labeling requirements are subject to a fine of up to 300 fine units. A legal person that violates packaging and labeling provisions is subject to a fine of up to 3,200 euros.
To align with FCTC Art. 11 and the FCTC Art. 11 Guidelines, the penalty provisions should specify a range of fines and penalties commensurate with the severity of the violation and whether it is a repeat violation. In addition, the law should consider other penalties such as license suspension and/or revocation. Further, penalties for manufacturers, importers, and wholesalers should be larger than those for retailers.
