Smoke Free Status of Indoor Public Places, Workplaces, and Public Transport
All indoor workplaces
The law prohibits smoking in some indoor workplaces but allows smoking in smoking rooms in other indoor workplaces. Therefore, the regulatory status code “Smoking is Restricted” is given.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all parts of all indoor workplaces.
All indoor public places
The law prohibits smoking in some indoor public places but allows smoking in smoking rooms in other indoor public places. Therefore, the regulatory status code “Smoking is Restricted” is given.

Private offices
The law permits smoking in smoking rooms in “office premises.” It is unclear whether a private office could be considered a smoking room.

Hospitals
The law permits smoking in smoking rooms in the premises of agencies or enterprises providing health services. Therefore, smoking is restricted in hospitals.

Residential healthcare facilities - public areas
The law permits smoking in smoking rooms in the premises of agencies or enterprises providing health services. Therefore, smoking is restricted in public areas of residential healthcare facilities.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all parts of residential healthcare facilities, including public areas.
Non-residential healthcare facilities
The law permits smoking in smoking rooms in the premises of agencies or enterprises providing health services. Therefore, smoking is restricted in non-residential healthcare facilities.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all parts of non-residential healthcare facilities.
Childcare facilities/preschools
The law prohibits smoking on the premises of children’s social welfare institutions, pre-school childcare institutions, and youth centers, and their designated territories.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to childcare facilities and preschools.
Primary and secondary schools
The law prohibits smoking on the premises of primary and secondary schools and their designated territories.

Universities/vocational facilities
The law prohibits smoking on the premises of vocational educational institutions. However, smoking is allowed in smoking rooms on the premises of institutions of higher education (universities).

Shops
The law prohibits smoking in the “sales areas of shops and mobile shops.” Therefore, smoking is permitted in areas where only employees are allowed. Therefore, the regulatory status code “Smoking is Restricted” is given.

Cultural facilities
The law permits smoking in smoking rooms in the premises of cultural institutions. Therefore, smoking is restricted in cultural facilities.

Restaurants

Casinos
The law permits smoking in smoking rooms in “rooms where a game of chance, betting or a totalizator is organized.” This is interpreted as restricting smoking in casinos.

Hotels/lodging - public areas
The law prohibits smoking in enterprises where services are offered, “except in accommodation establishments.” In addition, the law specifically permits smoking in smoking rooms in “public premises of enterprises.” Taken together, these provisions are interpreted as restricting smoking in public areas of hotels and lodging.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all parts of hotels and lodging, including public areas.
Hotels/lodgings - guest rooms
The law does not specifically address guest rooms in hotels and lodging. For premises not specified in the law, the law allows the possessor of the premises the discretion to decide whether smoking is allowed. Therefore, the regulatory status code “Smoking is Not Restricted” is given.

Prisons/detention facilities - public areas

Corridors, stairwells, and common areas of apartment buildings
The law prohibits smoking in corridors, stairwells, and common areas of apartment buildings.
