Analysis

While the law does not regulate or authorize regulation of cigarette contents, it does provide penalties for a violation of such regulation. A violation of emissions and ingredients regulations is subject to imprisonment from 1 to 5 years and a fine 10,000,000 to 500,000,000 FCFA. In addition, non-complying products may be confiscated and destroyed, a license or permit may be revoked, and the punishment may be publicly disclosed.

To align with FCTC Art. 9 and the FCTC Arts. 9 & 10 Guidelines, the law should regulate the contents of tobacco products. The law aligns with FCTC Art. 9 and the FCTC Arts. 9 & 10 Partial Guidelines in that it establishes sanctions for content regulation violations.
