Smoke Free Status of Indoor Public Places, Workplaces, and Public Transport
All indoor workplaces
The law prohibits smoking in many indoor public places and workplaces, except the law requires that designated smoking areas be created within certain places, including maritime and rail transport; airports; bus terminals, river terminals, maritime and rail terminals; hotels, beverage shops, discothè€ques, nightclubs, casinos, restaurants and supermarkets.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all indoor workplaces.
All indoor public places
The law prohibits smoking in many indoor public places and workplaces, except the law requires that designated smoking areas be created within certain places, including maritime and rail transport; airports; bus terminals, river terminals, maritime and rail terminals; hotels, beverage shops, discothè€ques, nightclubs, casinos, restaurants and supermarkets.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all indoor public places.
All public transport
The law prohibits smoking in all public transport vehicles that carry passengers. This includes trains, buses, shared ground transportation, boats, and aircraft. However, the law requires that smoking sections be created in trains and watercraft.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all public transport.
Government facilities
The law prohibits smoking in all government and public buildings.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to government facilities.
Private offices
The law does list private offices in the list of places where smoking is restricted and the definitions used in the law do not provide interpretive guidance as to whether smoking in private offices is regulated.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all indoor workplaces, including private offices.
Hospitals
The law prohibits smoking in all hospital establishments and healthcare facilities.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to hospitals.
Residential healthcare facilities - public areas
The law prohibits smoking in all hospital establishments and healthcare facilities.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to residential healthcare facilities.
Non-residential healthcare facilities
The law prohibits smoking in all hospital establishments and healthcare facilities.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to non-residential healthcare facilities.
Childcare facilities/preschools
The law prohibits smoking in all preschools and places intended for the reception of minors.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to childcare facilities and preschools.
Primary and secondary schools
The law prohibits smoking in all establishments intended for the reception, training or accommodation of minors and in uncovered areas of educational institutions. Therefore, smoking is prohibited in primary and secondary schools.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to primary and secondary schools.
Universities/vocational facilities
The law prohibits smoking in all places open to the public and in uncovered spaces in universities. The law is therefore interpreted as prohibiting smoking in universities and vocational facilities.

Shops
The law prohibits smoking in all enclosed or covered places open to the public and workplaces. This includes shops.

Cultural facilities
The law prohibits smoking in all enclosed or covered places open to the public and workplaces. This includes cultural facilities.

Indoor stadium/arenas
The law prohibits smoking in all enclosed or covered places open to the public and workplaces and specifically in athletic stadiums. Therefore, smoking is prohibited in indoor stadiums and arenas.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with regard to indoor stadiums and arenas.
Restaurants
The law requires that designated smoking areas be created within restaurants.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in restaurants.
Bars/pubs/nightclubs
The law requires that designated smoking areas be created within beverage shops, discotheques, and nightclubs.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all bars, pubs and nightclubs.
Casinos
The law requires that designated smoking areas be created within casinos.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all casinos.
Hotels/lodging - public areas
The law requires that designated smoking areas be created in hotels, which is interpreted as including public areas of hotels.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in public areas of hotels.
Hotels/lodgings - guest rooms
The law requires that designated smoking areas be created in hotels, but it is unclear whether guest rooms in hotels are included under this requirement.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all parts of all indoor public places and indoor workplaces, including guest rooms of hotels.
Prisons/detention facilities - public areas
The law prohibits smoking in all enclosed or covered places open to the public and workplaces. This includes the public areas of prisons.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with regard to prisons.
Trains, buses and other shared ground transportation other than taxis
The law prohibits smoking in all land transportation vehicles that carry passengers including buses and other shared ground transportation. However, the law requires that smoking sections be created in trains.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all shared ground transportation at all times with no exemptions.
Taxis (for-hire vehicle)
The law prohibits smoking in all land transportation vehicles that carry passengers, with the exception of trains, which require designated smoking sections. Therefore, the law is interpreted as including taxis.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with regard to taxis.
Commercial aircraft
The law prohibits smoking in air transportation that can carry passengers. This includes commercial aircraft.

Commercial watercraft
The law prohibits smoking in sea, river and lake transportation that can carry passengers. However, the law requires that smoking sections be created in maritime transport.

Public transport facilities (waiting areas for mass transit)
The law requires that airports, bus terminals, river terminals, maritime and rail terminals have designated smoking area.
