Violations of packing and labeling provisions of the Public Health Act are subject to a fine of not more than 750 penalty units or imprisonment of not more than three years, or both. Inspectors may seize products found to be in violation of packaging and warning provisions.
The law aligns with FCTC Art. 11 and the FCTC Art. 11 Guidelines in that it provides for penalties for violations. To more fully align with FCTC Art. 11 and the FCTC Art. 11 Guidelines, the drafters of the law should consider imposing addition penalties, such as license suspension or revocation, and higher fines for repeat violations.
