Smoke Free Status of Outdoor Places
Parking lots
The law prohibits the consumption of tobacco-derived products, which includes smoked and smokeless tobacco products and e-cigarettes, in all parts of all workplaces and in all public places except for the very limited exceptions of in cigar factories and spaces where tobacco tasting takes place. In addition, the law specifically bans the consumption of tobacco-derived products in parking lots.
Outdoor stadiums, arenas
The law prohibits the consumption of tobacco-derived products, which includes smoked and smokeless tobacco products and e-cigarettes, in all parts of all workplaces and in all public places except for the very limited exceptions of in cigar factories and spaces where tobacco tasting takes place. Outdoor stadiums and arenas are considered to be workplaces and/or public places. In addition, the law specifically bans the consumption of tobacco-derived products in “centers designed for entertainment, sports, and culture.” Therefore, smoking is banned in outdoor stadiums and arenas.
Public and private educational centers
The law prohibits the consumption of tobacco-derived products, which includes smoked and smokeless tobacco products and e-cigarettes, in all parts of all workplaces and in all public places except for the very limited exceptions of in cigar factories and spaces where tobacco tasting takes place. In addition, the law specifically bans the consumption of tobacco-derived products in “public and private educational centers.” Outdoor areas of such educational centers are considered to be workplaces and/or public places. We interpret “public and private educational centers” to include childcare facilities/preschools, primary and secondary schools, universities, and vocational schools. Therefore, smoking is banned in outdoor areas at public and private educational centers.
Means of public and private transportation, including their terminals
The law prohibits the consumption of tobacco-derived products, which includes smoked and smokeless tobacco products and e-cigarettes, on all means of public and private transportation, including their terminals. Therefore, the ban covers outdoor areas of both the means of transportation and their terminals.
Fuel service stations
The law prohibits the consumption of tobacco-derived products, which includes smoked and smokeless tobacco products and e-cigarettes, in all parts of all workplaces and in all public places except for the very limited exceptions of in cigar factories and spaces where tobacco tasting takes place. Fuel service stations are considered to be workplaces and/or public places. In addition, the law specifically prohibits the consumption of tobacco-derived products at fuel service stations.
Any public or private space at fewer than two meters from where people gather or pass through
The law prohibits the consumption of tobacco-derived products, which includes smoked and smokeless tobacco products and e-cigarettes, in all parts of all workplaces and in all public places except for the very limited exceptions of in cigar factories and spaces where tobacco tasting takes place. In addition, the law bans smoking in any public or private space at fewer than two meters from where people gather or pass through (e.g., sidewalks).
