Advertising and Promotion
Any person who violations the provisions on tobacco advertising
For audiovisual media – the Ministry of Economic Development; for other types of media – unspecified
Violations of the provisions on advertising in print media, radio, or internet are subject to a fine of EUR 2,582.25 to EUR 25,822.80. Violations of the provisions on advertising in audiovisual media are subject to a fine from EUR 10,329 – EUR 258,228. Penalties for violating other provisions on tobacco advertising and promotion are not specified.
The law aligns with FCTC Art. 13 and the FCTC Art. 13 Guidelines in that it specifies a range of fines for some types of tobacco advertising violations. However, to more fully align, the law should specify penalties for all types of tobacco advertising and promotion violations. In addition, the law should contain a range of fines and penalties commensurate with the seriousness of the violation. The legal drafters should also consider imposing non-monetary penalties such as license suspension or revocation.
