Penalties
Sales Restrictions
The law does not specify penalties for violations of restrictions on tobacco vending machine sales.
A manufacturer or importer who violates the ban on sales of oral tobacco or the restrictions on internet sales is subject to a fine from €30,000.00 to €150,000.00. A distributor or retailer who violates the ban on sales of oral tobacco or the restrictions on internet sales is subject to a fine from €500.00 to €5,000.00.
The Ministry of Health and the Ministry of Economy and Finance are responsible for implementation and enforcement.
Location-based Sales Restrictions
Tobacco sales are not restricted by location; therefore, there are no associated penalties.
Minimum Retail Package Size
A manufacturer or importer who violates the ban on the sale of cigarettes in packages of less than 20 or waterpipe/roll-your-own "rolling" tobacco in packages of less than 3 grams is punishable by a fine from €20,000.00 to €120,000.00.
The Ministry of Health and the Ministry of Economy and Finance are responsible for implementation and enforcement.
Minimum Legal Sales Age
Violations of the ban on sales to persons below the age of 18 are punishable by a fine from €500.00 to €3,000.00 and license suspension for fifteen days. Repeat violations are punished by a fine from €1,000.00 to €8,000.00 and license revocation.
