Analysis
An authorized officer is permitted to remove an offending person from the premises or public conveyance where the offense is taking place. An “authorized officer” is defined as: (a) a constable; (b) a customs officer appointed under the Customs Act; (c) a Medical Officer (Health); or (d) any other person so designated by the Minister.
To more fully align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should impose a duty to investigate complaints and possible violations of the law.
