Sales Restrictions
(e.g., seizure of the product, publication of the violation/violator)
A person who violates the prohibition on the sale of single cigarettes is liable to a fine not exceeding 50,000 shillings, or imprisonment not exceeding six months, or both. A person who violates the ban on tobacco sales by vending machine is liable to fine not exceeding 100,000 shillings, imprisonment for a term not exceeding 12 months, or both. In addition, the tobacco products and the means of sale may be seized by enforcement authorities.
Location-based Sales Restrictions
Tobacco sales are not restricted by location in any way. Therefore, there are no associated penalties for violations.
Minimum Retail Package Size
(e.g., seizure of the product, publication of the violation/violator)
A person who violates the minimum retail package size requirements is liable to a fine not exceeding 50,000 shillings, imprisonment not exceeding six months, or both. In addition, the non-complying tobacco products may be seized by enforcement authorities.
Minimum Legal Sales Age
A person who violates the minimum legal sales age is liable to a fine not exceeding 50,000 shillings, imprisonment for a term not exceeding six months, or both.
