Smoke Free Status of Indoor Public Places, Workplaces, and Public Transport
All indoor workplaces
The law prohibits smoking in a list of specified places that includes most workplaces and public places. However, “premises designated for smoking” are permitted in several places, including prisons, hotel guest rooms, casinos, games rooms, and departure halls of international airports. As a result of these exemptions, the regulatory status code “Smoking is Restricted” is given.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all indoor workplaces.
All indoor public places
The law prohibits smoking in a list of specified places that includes most workplaces and public places. However, “premises designated for smoking” are permitted in several places, including prisons, casinos, games rooms, and departure halls of international airports. As a result of these exemptions, the regulatory status code “Smoking is Restricted” is given.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all indoor public places.
All public transport
The law prohibits smoking in the main common areas, cabs and cabins of public vehicles, taxis, and passenger ships. Long-distance trains and passenger ships may have separate smoking cars or cabins. Therefore, the regulatory status code “Smoking is Restricted” is given.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all public transport.
Government facilities
The law prohibits smoking in public buildings, structures and public premises. Although the law permits that “areas” be specially designated for smoking, the definition of “area specially designated for smoking” indicates that these areas must be outside. Therefore, smoking is prohibited in government facilities.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to government facilities.
Private offices
The law prohibits smoking in a list of specified places that includes most workplaces and public premises. Although private offices aren’t specifically listed, smoking is prohibited in “work areas and common areas” of workplaces. This provision is interpreted as prohibiting smoking in private offices.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to private offices. For greater clarity, the law should define the term “workplace” in accordance with the definition provided in the FCTC Art. 8 Guidelines.
Hospitals
The law prohibits smoking anywhere on the premises of healthcare institutions. Although the law permits that “areas” be specially designated for smoking, the definition of “area specially designated for smoking” indicates that these areas must be outside.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to hospitals.
Residential healthcare facilities - public areas
The law prohibits smoking in healthcare institutions, rehabilitation institutions, and their premises. Although the law permits that “areas” be specially designated for smoking, the definition of “area specially designated for smoking” indicates that these areas must be outside.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to public areas of residential healthcare facilities.
Non-residential healthcare facilities
The law prohibits smoking in healthcare institutions, rehabilitation institutions, and their premises. Although the law permits that “areas” be specially designated for smoking, the definition of “area specially designated for smoking” indicates that these areas must be outside.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to non-residential healthcare facilities.
Childcare facilities/preschools
The law prohibits smoking anywhere on the premises of educational or social care institutions, children’s recreation groups, and playgrounds.

Primary and secondary schools
The law prohibits smoking anywhere on the premises of educational institutions. Therefore, smoking is prohibited in primary and secondary schools.

Universities/vocational facilities
The law prohibits smoking anywhere on the premises of educational institutions. Therefore, smoking is prohibited in universities/vocational facilities.

Shops
The law prohibits smoking in a list of specified places that includes most workplaces and public premises. Although shops aren’t specifically listed, smoking is prohibited in “work areas and common areas” and “any other public area not mentioned … in the presence of another person.” These provisions are interpreted as prohibiting smoking in shops.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to shops.
Cultural facilities
The law prohibits smoking in most workplaces and public premises with a few exceptions that do not include cultural facilities.

Indoor stadium/arenas
The law prohibits smoking during sports and other public events in stadiums and other similar areas.

Restaurants
The law prohibits smoking in cafes, restaurants, and other public food establishments.

Bars/pubs/nightclubs
The law prohibits smoking in cafes, restaurants, and other public food establishments. This is interpreted as prohibiting smoking in bars, pubs, and nightclubs.

Casinos
The law prohibits smoking in casinos except in premises specifically designated for smoking or in in separate marked and partitioned premises that are intended for smoking. Smoking premises must comprise less than 50% of the common public premises. Therefore, the regulatory status code “Smoking is Restricted” is given.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit all smoking in casinos.
Hotels/lodging - public areas
The law prohibits smoking in a list of specified places that includes most workplaces and public premises. Although public areas of hotels/lodgings aren’t specifically listed, smoking is prohibited in “work areas and common areas” and “any other public area not mentioned … in the presence of another person.” These provisions are interpreted as prohibiting smoking in public areas of hotels.

Hotels/lodgings - guest rooms
While smoking is generally prohibited in guest rooms in hotels or lodging, the law permits specifically designated rooms in which smoking is permitted. Therefore, the regulatory status code “Smoking is Restricted” is given.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all guest rooms.
Prisons/detention facilities - public areas
The law prohibits smoking on the premises of correctional institutions and territories used by these institutions, except for designated smoking premises. Therefore, the regulatory status code “Smoking is Restricted” is given.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all public areas of prisons/detention facilities.
Trains, buses and other shared ground transportation other than taxis
The law prohibits smoking in the main common areas and cabins of public vehicles. However, long-distance trains are allowed to have separate smoking cars. Therefore, the regulatory status code “Smoking is Restricted” is given.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in trains, buses, and other shared ground transportation.
Taxis (for-hire vehicle)
The law prohibits smoking in taxis.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to taxis (for-hire vehicles).
Commercial aircraft
The law prohibits smoking in the cabins of public vehicles. This is interpreted to include commercial aircraft.

Commercial watercraft
The law prohibits smoking in the main common areas and cabins of passenger ships. However, long-distance passenger ships are allowed to have designated smoking cabins. Therefore, the regulatory status code “Smoking is Restricted” is given.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in commercial watercraft.
Public transport facilities (waiting areas for mass transit)
The law prohibits smoking in shelters at public transportation stops and on platforms. However, in international airports, areas designated for smoking are permitted in public departure halls behind safety control points. Therefore, the regulatory status code “Smoking is Restricted” is given.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all public transport facilities, including airports.
