Analysis

Violators of disclosure requirements are subject to imprisonment from one to five years, or a fine of 250,000 to 10,000,000 francs, or both. In addition, any product placed on the market without disclosure of required information, or with disclosure of incorrect information, may be seized and destroyed.

The law aligns with FCTC Art. 10 and the FCTC Arts. 9 & 10 Partial Guidelines in that the law imposes sanctions for disclosure violations.
