Smoke Free Status of Indoor Public Places, Workplaces, and Public Transport
All indoor workplaces
The law prohibits smoking in a public place, which by definition includes all indoor workplaces and common areas used by employees during the course of employment or work.

The law prohibits smoking in public places.

The law prohibits smoking in a public place, which by definition includes a public conveyance.

Government facilities
The law prohibits smoking in public places, including government buildings and vehicles.
Therefore, the law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to government facilities.
Private offices
The law prohibits smoking in public places, including workplaces, defined as an indoor area where employment and work duties are performed and common areas used by employees during the course of employment or work. This is interpreted as prohibiting smoking in private offices.
Therefore, the law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to private offices.
Hospitals
The law prohibits smoking in public places, including indoor areas of hospitals.
Therefore, the law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to hospitals.
Residential healthcare facilities - public areas
The law prohibits smoking in public places including indoor areas of any clinic, medical center, or other health institution. This is interpreted as prohibiting smoking in public areas of residential healthcare facilities.
Therefore, the law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to public areas of residential healthcare facilities.
Non-residential healthcare facilities
The law prohibits smoking in public places including indoor areas of any clinic, medical center, or other health institution. This is interpreted as prohibiting smoking in non-residential healthcare facilities.
Therefore, the law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to non-residential healthcare facilities.
Childcare facilities/preschools
The law prohibits smoking in public places including indoor areas of any pre-primary institution or any other premises where services to children are provided.

Primary and secondary schools
The law prohibits smoking in public places, including indoor areas of any primary or secondary educational institution.

Universities/vocational facilities
The law prohibits smoking in public places, including indoor areas of any tertiary educational institution.

Shops
The law prohibits smoking in public places, including markets, shopping malls, and retail and wholesale establishments.

Cultural facilities
The law prohibits smoking in public places including cinema halls, theaters, video houses, such other halls or places of performance, dance halls, and any other entertainment facilities.

Indoor stadium/arenas
The law prohibits smoking in public places, including indoor stadiums.

The law prohibits smoking in public places including indoor areas of bars and nightclubs.

Casinos
The law prohibits smoking in public places including entertainment facilities. This is interpreted as prohibiting smoking in casinos.
Therefore, the law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to casinos.
Hotels/lodging - public areas
The law prohibits smoking in public places. Although the Public Health (Restrictions on Tobacco Products) (Amendment No. 2) Regulations 2023 removed the word "hotels" from the list of public places in Schedule 1, indoor public areas of hotels still qualify as public places under the definition in Art. 2 - "an indoor area or part of an indoor area which is open to the public." Therefore, the law is interpreted as prohibiting smoking in public indoor areas of hotels.
The law permits hotels to import waterpipe and waterpipe tobacco to be used only in a demarcated area of a hotel, subject to specific requirements, including the area being an outdoor area distinctively marked for waterpipe smoking, not being used for food, drink, or other services, and children being prohibited from the area. Because these areas must be outdoor areas, this exception does not affect the regulatory status code of this category.

Hotels/lodgings - guest rooms
The law prohibits smoking in public places, which includes hotels, but does not specifically address guest rooms. Therefore, the regulatory status code “Uncertain” is given.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should explicitly prohibit smoking in guest rooms in hotels and lodging facilities.
Prisons/detention facilities - public areas

As a public conveyance is any means of transport carrying passengers for hire or reward, the law prohibits smoking on trains, buses, and other shared ground transportation.

Taxis (for-hire vehicle)
The law prohibits smoking while driving or traveling in a vehicle carrying passengers or while being in a stationary vehicle carrying passengers. The law also prohibits smoking in public places, which by definition includes public conveyances. As a public conveyance is any means of transport carrying passengers for hire or reward, the law prohibits smoking in taxis.

Commercial aircraft
The law prohibits smoking while driving or traveling in a vehicle carrying passengers or while being in a stationary vehicle carrying passengers. The law also prohibits smoking in public places, which by definition includes public conveyances. As a public conveyance is any means of transport carrying passengers for hire or reward, the law prohibits smoking on commercial aircraft.
Therefore, the law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to commercial aircraft.
Commercial watercraft
The law prohibits smoking while driving or traveling in a vehicle carrying passengers or while being in a stationary vehicle carrying passengers. The law also prohibits smoking in public places, which by definition includes public conveyances. As a public conveyance is any means of transport carrying passengers for hire or reward, the law prohibits smoking on commercial watercraft.
Therefore, the law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to commercial watercraft.
Public transport facilities (waiting areas for mass transit)
The law prohibits smoking in public places including all indoor areas of bus stands, bus stations, railway or tramway stations, airports, airfields, ports, and other transport terminals.
Therefore, the law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to public transport facilities.
Recreational places
The law prohibits smoking in public places including indoor recreational places including wellness/health and recreational parks, gardens, and public beaches to which the public has access.
Places of worship
The law prohibits smoking in public places including places of worship.
Homes for children
The law prohibits smoking in public places including indoor areas of homes for children and other premises where services to children are provided.
