Analysis

Most advertising violations are punishable by a fine ranging from 84 to 90 conventional units for a natural person, and 270 to 300 conventional units for a legal entity. In addition, penalties may include revocation of their license for six months to one year.

Violations of certain provisions, such as the prohibition of brand stretching, reverse brand stretching, and free distribution, are punishable by a fine ranging from 60 to 72 conventional units for a natural person, and 240 to 270 conventional units for a legal entity. In addition, penalties may include revocation of their license for six months to one year.

The law aligns with FCTC Art. 13 and the FCTC Art. 13 Guidelines in that it imposes a range of penalties for violations of the law. The law could be strengthened by imposing increased penalties for repeat violations.
