Smoke Free Status of Indoor Public Places, Workplaces, and Public Transport
All indoor workplaces
The amended law prohibits smoking in all enclosed and semi-enclosed workplaces.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to indoor workplaces. However, the law allows designated smoking areas in semi-open places, which are defined as any place that is less than 50% enclosed. To better align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all indoor workplaces, even those that are semi-open.
All indoor public places
The law prohibits smoking in all enclosed and semi-enclosed public places as well as all public places managed by healthcare facilities, educational institutions, and local public authorities.

All public transport
The law prohibits smoking in all means of public transportation.

Government facilities
The law prohibits smoking in all public places managed by central and local public authorities whether open or enclosed. Therefore, smoking is prohibited in government facilities.

Private offices
The law generally prohibits smoking in any enclosed or semi-enclosed public place or workplace, including private offices. The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to private offices.

Non-residential healthcare facilities
The law prohibits smoking in all public places managed by healthcare facilities whether open or enclosed. Therefore, smoking is prohibited in non-residential healthcare facilities.

Childcare facilities/preschools
The law prohibits smoking in all public places managed by educational institutions whether open or enclosed. Therefore, smoking is prohibited in childcare facilities and preschools.

Primary and secondary schools

Prisons/detention facilities - public areas
The law does not specifically address smoking in prisons. Smoking is prohibited in enclosed and semi-enclosed public places and workplaces. Because prisons are generally enclosed places, and are workplaces for some, the law is interpreted as banning smoking in prisons and detention facilities.

Trains, buses and other shared ground transportation other than taxis
The law prohibits smoking on all public transportation. Therefore, smoking is prohibited on trains, buses, and other shared ground transportation.

Taxis (for-hire vehicle)
The law prohibits smoking on all public transportation, specifically including taxis. Therefore, smoking is prohibited in taxis.

Commercial aircraft

Private transport when minors are present
The law prohibits smoking in private vehicles when minors are present.
