COMMENTS: The Control of Smoking and Consumption of Tobacco Product Law is the primary law regulating smoke free places; tobacco advertising, promotion and sponsorship; and packaging and labeling of tobacco products.

COMMENTS: The Letter from the President's Office on Instructions for Smoke Free Government Offices instructs ministries and government offices to ban smoking and chewing betel quid in government facilities.

COMMENTS: Ministry of Health Notification No. 5/2014, Order Stipulating the Caption, Sign and Marks Referring to the "No-Smoking Area" specifies the requirements of signs to be displayed in smoke free places.

COMMENTS: Ministry of Health Notification No. 6/2014, Order Stipulating the Requirements to be Managed at the Specific Area where Smoking is Allowed specifies the requirements of signs to be displayed in designated smoking areas; duties of the persons-in-charge; and offenses under the law.

COMMENTS: The Order of Printing Warning Images and Texts on the Packaging of Tobacco Products, issued by Proclamation No. 11/2016, includes the requirements for graphic health warnings to cover 75% of the front and back faces of tobacco product packaging. The Order also requires text statements on the side faces and prohibits the use of misleading terms on tobacco product packaging.

COMMENTS: Notification No. 62/2022 amends the effective date of Order No. 453/2021 to January 1, 2023. However, the effective date was further delayed by Notification No. 203/2022.

COMMENTS: Ministry of Health Order No. 453/2021 requires plain packaging of cigarettes. The Order also contains updated pictorial health warnings to be included on tobacco product packaging. Ministry of Health Order No. 453/2021 repeals Proclamation No. 11/2016, Order of Printing Warning Images and Texts on the Packaging of Tobacco Products. This Order was subsequently amended twice - first in April 2022 and second in September 2022 - delaying the date on which plain packaging comes into effect from April 10, 2022 until December 31, 2023.

COMMENTS: Notification No. 203/2022 amends the effective date of Order No. 453/2021 to December 31, 2023. As of this date, plain packaging of cigarettes will be required at the manufacturer level, with plain packaging of cigarettes required at the retail level 90 days later - March 31, 2024.
