Smoke Free Status of Indoor Public Places, Workplaces, and Public Transport
All indoor workplaces
The Act provides that premises to which the public has access and work premises shall be smoke free. There are some exceptions to the ban, including for institutions that replace the residents' home and up to one half of hotel guest rooms.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should require all parts of all indoor public places and workplaces to be 100% smoke free.
All indoor public places

Private offices
The Act provides that premises to which the public has access and work premises, including meeting rooms, shall be smoke free. There are some exceptions to the ban, but no exceptions are made for private offices. Therefore, the law is interpreted as prohibiting smoking in indoor private offices.

Hospitals
The Act provides that premises to which the public has access and work premises shall be smoke free. There are some exceptions to the ban, but no exceptions are made for hospitals. Therefore, smoking is prohibited in hospitals. The law also prohibits smoking near the outdoor entrances to health institutions.

Residential healthcare facilities - public areas
The Act provides that premises to which the public has access and work premises shall be smoke free. There are some exceptions to the ban, including an exception for institutions that replace the residents' home. In these institutions, smoking may be permitted in “specially indicated day rooms.” Equivalent smoke free rooms must be made available as well. (The exception does not apply to institutions where most of the residents are under 18 years of age.)

Childcare facilities/preschools
Smoking is prohibited in all indoor and outdoor areas of kindergartens and nurseries.

Primary and secondary schools
Smoking is prohibited in all indoor and outdoor areas of primary schools, lower secondary schools, and upper secondary schools.

Universities/vocational facilities

Shops

Cultural facilities

Indoor stadium/arenas

Restaurants
The law explicitly prohibits smoking in establishments that serve food and/or drink on the premises. Therefore, smoking is prohibited in restaurants.

Bars/pubs/nightclubs

Casinos
The Act provides that premises to which the public has access and work premises shall be smoke free. There are some exceptions to the ban, but no exceptions are made for casinos. The law also explicitly prohibits smoking in establishments that serve food and/or drink on the premises. Therefore, smoking is prohibited in casinos.

Hotels/lodging - public areas
The Act provides that premises to which the public has access and work premises shall be smoke free. There are some exceptions to the ban, including a provision permitting “up to one half of the bedrooms in hotels and other overnight accommodations” to be designated as smoking rooms. However, there exception does not include public areas of hotels and lodging. Therefore, public areas of hotels are interpreted as 100% smoke free.

Hotels/lodgings - guest rooms
The Act explicitly provides that smoking may be permitted “in up to one half of the bedrooms in hotels and other overnight accommodations.” Therefore, smoking is permitted in designated hotel guest rooms and prohibited in other guest rooms.

Prisons/detention facilities - public areas
The Act provides that premises to which the public has access and work premises shall be smoke free. There are some exceptions to the ban, including an exception for institutions that replace the residents' home, which is interpreted to include prisons and detention facilities. In these institutions, smoking may be permitted in “specially indicated day rooms.” Equivalent smoke free rooms must be made available as well. (The exception does not apply to institutions where most of the residents are under 18 years of age.)

Trains, buses and other shared ground transportation other than taxis
The Act prohibits smoking in means of public transport, which includes shared ground transportation such as trains and buses.
