Police officers of the rank of Sub-Inspector and above
For the first offense, a fine up to 5,000 rupees. For the second offense, imprisonment up to three months, a fine not less than 100,000 rupees, or both.
To align with Art. 13 and the FCTC Art. 13 Guidelines, the law should provide for a range of penalties – including license suspension and revocation - and for corrective action. In addition, consideration should be given to whether 5,000 rupees (approximately $55) is a large enough penalty to deter violation by the tobacco and/or advertising industry.
