Anyone who violates tobacco advertising and promotion provisions is subject to up to one year in prison, a fine between 200 and 1000 dinars, or both.

The Anti-Smoking Law and Regulations state that the "competent authorities" "shall enforce" the provisions of the law and regulations. However, neither the law nor the regulations explicitly authorize a specific agency with enforcement authority.

The law aligns with FCTC Art. 13 and the FCTC Art. 13 Guidelines in that it contains fines and penalties for violations. To more fully align with FCTC Art. 13 and the FCTC Art. 13 Guidelines, the drafters of the law should consider imposing license suspension and/or revocation for violations and imposing increased fines for repeat violations. In the addition, the law or regulations should identify the agency(s) with enforcement authority.
