Anyone who violates packaging and labeling provisions is subject to up to one year in prison, a fine between 200 and 1000 dinars, or both. In addition, tobacco products that are not properly packaged or labeled shall be confiscated and the factory or store where the tobacco was seized may be closed.
The Anti-Smoking Law and Regulations state that the "competent authorities" "shall enforce" the provisions of the law and regulations. However, neither the law nor the regulations explicitly authorize a specific agency with enforcement authority.
The law aligns with FCTC Art. 11 and the FCTC Art. 11 Guidelines in that it contains a range of fines and penalties commensurate with the severity of the violation. To more fully align with FCTC Art. 11 and the FCTC Art. 11 Guidelines, the law should specify higher fines for repeat violations.
