The law does not provide a specific penalty for violations of provisions regulating the contents of tobacco products. However, the law provides a general penalty for "non-observance of the restrictions in the trade of tobacco products and tobacco goods," which may apply. Under this provision, a content regulation violation would be subject to a fine: 1) on citizens, from 2,000.00 to 3,000.00 rubles, 2) on officials, from 5,000.00 to 10,000.00 rubles, and 3) on legal entities, from 30,000.00 to 50,000.00 rubles. If this provision applies, the penalties are relatively low for this type of violation.
To align with FCTC Art. 9 and the FCTC Arts. 9 & 10 Guidelines, the law should clarify whether these penalties apply, and, if not, provide specific and appropriate penalties for a violation of content regulations.
Disclosure requirement
There are no penalties specified for violation of disclosure requirements.
To align with FCTC Art. 10 and the FCTC Arts. 9 & 10 Partial Guidelines, the law should impose sanctions for disclosure violations.
