Any person that produces or supplies a tobacco product that does not comply with warning requirements is guilty of an offense and is subject to the following penalties: 1) on summary conviction - imprisonment not exceeding three months, a fine, or both; 2) on conviction on indictment - imprisonment not exceeding two years, a fine, or both.
The law aligns with FCTC Art. 11 and the FCTC Art. 11 Guidelines in that it provides for penalties for violations of packaging and labeling requirements. To more fully align, the drafters of the law should consider increased penalties for repeat offenses and additional penalties such as license suspension or revocation.
