Tobacco Control Act
COMMENTS: The Tobacco Control Act provides for tobacco control measures relating to restrictions on smoking in public places; the manufacture, importation, and sale of tobacco products, including packaging and labeling requirements; tobacco advertising, promotion and sponsorship; establishment of the National Tobacco Control Board; and offenses and penalties.
Tobacco Control (Smoke-Free Notice) Regulations, 2011
COMMENTS: The Tobacco Control (Smoke-Free Notice) Regulations, 2011 specify the requirements of no smoking notices to be displayed in smoke free places.
Tobacco (Health Warnings and Messages) Regulations, 2012
COMMENTS: The Tobacco (Health Warnings and Messages) Regulations, 2012 prescribe the content and display of the required health warnings and provide for certain other packaging and labeling requirements. The regulations provided for a six-month transition period, with the new graphic health warnings required to be displayed as of March 26, 2013. These regulations were subsequently repealed by the Tobacco Control (Health Warnings and Messages) (Repeal) Regulations, 2014.
Tobacco Control (Health Warnings and Messages) (Amendment of Schedule) Regulations, 2013
COMMENTS: The Tobacco Control (Health Warnings and Messages) (Amendment of Schedule) Regulations, 2013 contain graphic health warnings to replace those in the Tobacco (Health Warnings and Messages) Regulations, 2012. The images and messages are largely identical to those in the 2012 regulations, with only minor corrections/updates to the text of the warnings.
Tobacco (Inspections and Penalty) Regulations, 2014
COMMENTS: The Tobacco (Inspections and Penalty) Regulations, 2014 grant the Minister of Health the authority to appoint certain public officers to enforce the law. Under the regulations, the authorized officers can issue “spot fines” for smoking where prohibited.
Tobacco Control (Health Warnings and Messages) (Repeal) Regulations, 2014
COMMENTS: The Tobacco Control (Health Warnings and Messages) (Repeal) Regulations, 2014 repeal the Tobacco (Health Warnings and Messages) Regulations, 2012.
Tobacco (Inspections and Penalty) (Amendment) Regulations, 2015
COMMENTS: The Tobacco (Inspections and Penalty) (Amendment) Regulations, 2015 and an offense to the list of offenses for which authorized officers can issue "spot fines."
Tobacco Control (Health Warnings and Messages) Regulations, 2015
COMMENTS: The Tobacco Control (Health Warnings and Messages) Regulations, 2015 establish the graphic health warnings required to appear on product packaging. The regulations include eight warnings in English, eight warnings in French, and four warnings in Creole. Manufacturers, importers, suppliers, and distributors have 12 months to comply with the new warning requirements.
Tobacco Control (Sale of Packages and Single Cigarette) Regulations, 2019
COMMENTS: The Tobacco Control (Sale of Packages and Single Cigarette) Regulations, 2019 prohibit the sale of single cigarettes and packs of fewer than 10 cigarettes.
