Additive
“Additive” means a substance that forms part of a tobacco product that is not cured tobacco leaf; and includes –
(a) a substance forming part of the product that has been derived or refined from tobacco leaf (whether cured or not); or
(b) any substance that is introduced into a product during processing, manufacturing, or packaging including, as appropriate, those contained in the paper, filter, portion pouch or similar part of the tobacco product.
The definition of “additive” is significant because the law prohibits any pigments or inks as additives (with a few exceptions) and because information about additives must be included in annual reports submitted to the Ministry of Health.
Constituents
“Constituents” means -
(a) for tobacco products intended for smoking, the chemicals found in the product itself or in the smoke emitted from the product; and
(b) for smokeless tobacco products, the chemicals inherent in the tobacco itself released by particles during the process of consumption.
The definition of “constituents” is significant because the law requires that certain information about constituents be included on packaging.
Emissions
“Emissions” means substances that are released when the tobacco product is used as intended, such as –
(a) for cigarettes or other combusted products emissions, the substances found in smoke;
(b) for smokeless tobacco products for oral use, the substances released during the process of chewing or sucking; or
(c) for nasal use, the substances released by particles during the process of snuffing.
The definition of “emissions” is significant because the law requires reporting and warning requirements for emissions of tar, nicotine, and carbon monoxide.
Toxic constituent
“Toxic constituent” means any substance prescribed by regulations to be a toxic constituent, and includes any substance found in a tobacco product or in its smoke.
