Violations of packaging and labeling requirements are punishable by: on summary conviction, a fine of 100,000 dollars and imprisonment for six months; or on conviction on indictment, a fine of 200,000 dollars and imprisonment for one year. In addition, products not in compliance may be confiscated and forfeited and licenses may be suspended, revoked, or limited.
The law aligns with FCTC Art. 11 and the FCTC Art. 11 Guidelines in that it imposes a range of penalties for violations.
Importer
