Smoke Free Status of Outdoor Places
Outdoor care settings for children
Outdoor care settings for children are smoke-free. The outdoor area is an outdoor care setting: 1) if it is part of a premises registered and authorized to provide daycare for children, or 2) it is part of the premises that are the usual place of residence of a person registered to act as a child minder.
School grounds
School grounds are smoke-free to the extent they are being used for education or childcare. However, a smoking area may be designated on grounds that adjoin a school that provides residential accommodation to pupils provided that the designated smoking area: may not be used by a child under 18 years of age and must be no more than 8.25 square meters and at least 10 meters away from any other premises that are smoke-free.
Hospital grounds
Outdoor grounds that adjoin a hospital or are use or occupied by a hospital are smoke-free. However, an area may be designated for smoking on hospital grounds provided that the designated smoking area: may not be used by a child under 18 years of age and must be no more than 8.25 square meters and at least 10 meters away from any other premises that are smoke-free.
Public playgrounds
The premises within the boundaries of a public playgrounds are smoke-free. If the boundaries are not clearly marked, the area within five meters of any playground equipment is smoke-free.
