Action Required for Advertising, Promotion and Sponsorship Not Banned
Disclosure to the government by the tobacco industry of information on advertising, promotion and sponsorship activities and expenditures
The law requires manufacturers and importers of tobacco products to provide reports containing the information described in the Fourth Schedule to the Minister of Health. The Fourth Schedule requires reporting on advocacy advertising, corporate social responsibility, and any other information prescribed by the Minister of Health. Regulations, which have not yet been adopted, will describe all details of the reports, including but not limited to the frequency, format, method of reporting, and verification procedures.
The law aligns with FCTC Art. 13 and the FCTC Art. 13 Guidelines with respect to the disclosure to the government by manufacturers and importers of information on advertising, promotion and sponsorship activities and expenditures. To further align, the law should require disclosure by all tobacco industry parties, including wholesale distributors.
Health warning messages required on permitted forms of tobacco advertising, promotion and sponsorship
The law prohibits all forms of tobacco advertising, promotion and sponsorship expect for point-of-sale product display. The law does not explicitly require health warnings at the point of sale but states that regulations may require warnings. To date, no regulations have been issued.
To align with FCTC Art. 13 and the FCTC Art. 13 Guidelines with respect to health warnings and messages on permitted forms of advertising and promotion, the law should require health warnings at the point of sale.
Disclosed information readily available to the public
The law requires that information contained in the reports submitted by tobacco manufacturers and importers to widely and readily accessible to the public. Regulations, which have not yet been adopted, will describe all details of the reports, including but not limited to the frequency, format, method of reporting, and verification procedures.
The law aligns with FCTC Art. 13 and the FCTC Art. 13 Guidelines with respect to disclosure of information available to the public.
