Sale of e-cigarettes
The retail sale of e-cigarettes is allowed subject to restrictions under the law.
Use in indoor public places, workplaces, and public transport
Because the law defines “tobacco products” to include e-cigarettes and equates e-cigarettes with tobacco products, the definition of “tobacco smoking” is interpreted to include e-cigarette use. Therefore, the use of e-cigarettes is prohibited in healthcare facilities, educational facilities, cultural centers, taxis, and airplanes. For all other indoor public places, indoor workplaces, and public transport, e-cigarettes can be used only in designated areas whose requirements are set out in Decision No. 127/2018.
Advertising and promotion (excluding point of sale product display)
Law No. 887 defines “tobacco products” to include e-cigarettes and equates e-cigarettes with tobacco products. Therefore, the restrictions on tobacco product advertising and promotion contained in the law also apply to e-cigarettes. In addition, the Law on Advertising specifically applies to e-cigarettes. Taken together, these laws generally ban direct and indirect advertising and promotion of e-cigarettes.
Sponsorship
Law No. 887 defines “tobacco products” to include e-cigarettes and equates e-cigarettes with tobacco products. Therefore, the restrictions on tobacco product sponsorship contained in the law also apply to e-cigarettes. In addition, the Law on Advertising specifically applies to e-cigarettes. Taken together, these laws generally ban sponsorship of e-cigarettes.
Point of sale product display
The law does not address point of sale product display for e-cigarettes; therefore, point of sale product display for e-cigarettes is permitted.
Sale of e-cigarettes via the internet
The law does not address e-cigarette sales via the internet. Therefore, the law is interpreted as allowing internet e-cigarette sales.
Flavors (other than tobacco flavor)
The law does not address flavors in e-cigarettes; therefore, the use of flavors in e-cigarettes is allowed.
Specified ingredients/additives
The law does not address ingredients or additives in e-cigarettes; therefore, there are no restrictions on the use of ingredients or additives in e-cigarettes.
Health warnings on product packaging
The law does not require health warnings on e-cigarette product packaging.
Other product packaging and labeling requirements
The law does not address e-cigarette product packaging and labeling requirements.
Maximum nicotine concentration
The law does not address nicotine concentration levels in e-cigarettes; therefore, there is no prescribed maximum nicotine concentration.
Device requirements
The law does not address device requirements for e-cigarettes.
Manufacturer/importer disclosures and/or notification requirements
The law does not impose disclosure and/or notification requirements on e-cigarette manufacturers/importers.
