COMMENTS: Law No. 138-IIG on Tobacco and Tobacco Products regulates the production, import, export, and sales of tobacco products. The law establishes relevant definitions, and provides regulations on tobacco production in the country and export. The law contains several packaging and labeling requirements and sales restrictions. The law also includes provisions on the designation of smoke-free areas (Art. 21) and the sale of tobacco products (Art. 20), although these were later repealed by Law No. 887-VQ.

COMMENTS: The Law on Television and Radio Broadcasting establishes that advertising tobacco goods on television and radio is prohibited, along with other products. The uploaded files contain only relevant excerpts as amended in November 2019.

COMMENTS: Standard AZS 335:2009 on Tobacco Products – Packaging and Marking establishes several more definitions and provides the requirements for tobacco product packaging, including the health warnings required to appear on packaging.

COMMENTS: This law bans smoking on buses and other passenger vehicles, and provides the exception to the rule of no smoking in taxis.

COMMENTS:  The Law on Advertising regulates advertising generally, and contains provisions prohibiting advertising and sponsored advertising of tobacco, tobacco products and tobacco supplies. The uploaded files contain only relevant excerpts as amended in November 2019.

COMMENTS: The Code on Administrative Offenses contains provisions for penalties when persons violate the provisions on smoke-free areas, tobacco advertising, promotion, and sponsorship, and sales to minors. The uploaded files contain only relevant excerpts as amended in March 2020.

COMMENTS: Decree No. 1774 on the Implementation of Law No. 887-VQ on Restriction of Tobacco Use establishes the enforcement authorities for various provisions of Law No. 887-VQ.

COMMENTS: Law No. 887-VQ on Restriction of Tobacco Use is the primary tobacco control law, and contains provisions regulating smoke free places and tobacco advertising, promotion and sponsorship. In addition, the law establishes principles of protection and outlines responsibilities of the State and of municipalities.

COMMENTS: Decision No. 127 on Requirements for Specialized Places for Smoking regulates designated smoking areas.

COMMENTS: Resolution No. 159 amends Decree No. 179 dated October 19, 2010 regarding the terms of use the Baku Metro transportation system by prohibiting smoking at the gates, in vestibules, crossings, platforms, and metro cars.
