Sale of heated tobacco products
The law allows the sale of HTPs subject to a minimum sales age; location-based restrictions; and a ban on internet (devices are exempted from the ban) and vending machine sales.
Use in indoor public places, workplaces, and public transport
Existing smoking restrictions apply to HTPs. The law specifically regulating HTPs provides a list of places where smoking is either prohibited or restricted to designated areas. Many of these places are indoor public places, workplaces, and public transport. The law allows smoking in designated smoking areas in certain places including, but not limited to, healthcare facilities, cultural facilities, sports facilities, shops and consumer services facilities, catering facilities, and government facilities. Notably, smoking HTPs is prohibited in cars with children under the age of 14.
Advertising and promotion (excluding point of sale product display)
The law specifically regulating HTPs includes “smokeless tobacco products” as a “type of tobacco product,” which, by definition, includes tobacco inserts. The Law on Advertising prohibits most forms of tobacco advertising and promotion, with limited exceptions.
The law specifically regulating HTPs does not include any restrictions on the tobacco advertising and promotion of devices.
Sponsorship
Neither the law specifically regulating HTPs nor the Law on Advertising addresses tobacco industry sponsorship of events, activities, individuals, organizations, or governments. Therefore, the law is interpreted as allowing tobacco industry sponsorship of events, activities, individuals, organizations, or governments, including contributions to “corporate social responsibility” programs.
Neither the law specifically regulating HTPs nor the Law on Advertising addresses tobacco industry sponsorship of events, activities, individuals, organizations, or governments. Therefore, the law is interpreted as allowing tobacco industry sponsorship of events, activities, individuals, organizations, or governments, including contributions to “corporate social responsibility” programs.
Point of sale product display
The law specifically regulating HTPs includes “smokeless tobacco products” as a “type of tobacco product,” which, by definition, includes tobacco inserts. The law prohibits the display of “tobacco products” inside points of sale, with an exception provided for in store windows in duty-free shops.
The law specifically regulating HTPs does not address point of sale product display for devices. Therefore, point of sale product display of devices is allowed.

The law specifically regulating HTPs bans the sale of tobacco inserts via the internet.
The law specifically regulating HTPs exempts devices from the ban on HTP sales via the internet.

Health warnings on product packaging
The law specifically regulating HTPs lists information that is required on each product package. However, health warnings are not among the list of items that are required for “smokeless tobacco products,” which, by definition, includes tobacco inserts. A warning about the dangers of consumption of tobacco products must be included in a package insert for “smokeless tobacco products,” which, by definition, includes tobacco inserts.
