Analysis

Any person who engages in prohibited advertising, promotion, or sponsorship of tobacco products is subject to 2-6 months in prison and/or a fine of 100,000-1,000,000 Burundian francs.

Any manufacturer or importer of tobacco products who fails to provide the government authorities with the required information listed in the law, or knowingly provides them with false or misleading information, is subject to 1-3 years in prison, and a fine of 1,000,000 to 10,000,000 Burundian francs.

Any person who advertises at the point of sale is subject to a fine of 3-12 months in prison and/or a fine between 100,000-500,000 Burundian francs.

The law aligns with FCTC Art. 13 and the FCTC Art. 13 Guidelines in that it imposes a range of penalties for violations of tobacco advertising and promotion provisions. To more fully align, though, drafters should consider additional or alternative penalties such as license suspension or revocation.
