Tobacco Product
The lack of definition for this key term could render enforcement of the law difficult. To align with FCTC Art. 11 and the FCTC Art. 11 Guidelines, the law should provide a definition of “tobacco product” in accordance with the definition contained in the FCTC.
Any product entirely or partly made of the leaf tobacco as a raw material which is manufactured to be used for smoking, sucking, chewing, or snuffing. (FCTC Art. 1(f))
Outside Packaging and Labeling
Packing: packets, packets tins and any other unit used to prepare products for the consumer market.
The definition of “packing” contained in Ministry of Welfare Decision No. 003961 aligns with the definition of “outside packaging and labeling” contained in FCTC Art. 11 in that it encompasses all packaging used for retail sale.
Any packaging and labeling used in the retail sale of the product. (FCTC Art. 11(4))
