Analysis

Violations of the ban on tobacco advertising and promotion are punishable by one to five years of imprisonment and a fine of one hundred to two hundred million Congolese Francs. Conviction shall be accompanied by the suspension of all activities for a period of one year.

The operating license of the tobacco company in question may be revoked in the case of a repeat offense.

The law aligns with FCTC Art. 13 and the FCTC Art. 13 Guidelines in that it provides for a range of penalties and holds all applicable parties responsible for violations of tobacco advertising and promotion.
